Introduction

Accelerate Engine Limited ("Accelerate Engine", "we", "us", "our") is committed to protecting your privacy and managing your personal information responsibly and in accordance with the Privacy Act 2020. This Privacy Policy explains how we collect, use, store, disclose, and protect personal information when you use our services or software, visit our website, or otherwise interact with us.

We provide ACC levy review software and ACC administration and support services, working alongside accounting firms and their clients to identify ACC levy overpayments and manage ACC matters. Because of the nature of our services, some of the information we hold is provided to us by accounting firms in relation to their clients.

By using our website, software, or services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with how we handle personal information as described here, please do not use our website or provide us with personal information.

What Personal Information We Collect

We may collect and hold the following types of personal information:

  • Your name and contact details (address, email address, phone number) and, where relevant, your role or position
  • Business, company, and organisation details, including New Zealand Business Number (NZBN) and industry classification
  • ACC account and levy information, including ACC numbers, classification units (CUs), levy invoices, and levy history
  • Information about the accounting firm you work for or are a client of, where they engage us on your behalf
  • Records of your communications and interactions with us in relation to our software and services
  • Technical information collected automatically when you visit our website, such as your IP address (including the country it originates from), device and browser type, the pages you view, links you click, and how you navigate our site
  • Any other information you choose to provide to us when engaging our ACC review, administration, or support services

Much of the ACC and client information we process is provided to us by accounting firms (our partners) in relation to their clients, for the purpose of carrying out ACC levy reviews and ACC administration services on their behalf.

If certain information is not provided to us, we may be unable to carry out an ACC levy review or provide particular services.

How We Collect Personal Information

We collect personal information:

  • Directly from you when you engage us, partner with us, or use our software and services
  • From accounting firms and advisors who engage us to carry out ACC levy reviews or ACC administration for their clients, where they are authorised to provide that information
  • From ACC (the Accident Compensation Corporation) and other agencies, where you or your accountant have authorised us to obtain it or where it is necessary to provide our services
  • When you contact us via phone, email, or through our website
  • When you complete forms, subscribe to our updates, or follow or interact with us on social media

We also collect information automatically through your use of our website using cookies and similar technologies, as described further below.

Why We Collect and Use Your Personal Information

We collect and use personal information for the following purposes:

  • To provide our ACC levy review software and ACC administration and support services
  • To review ACC levies and identify potential ACC levy overpayments and refunds
  • To connect with ACC's invoicing and client management systems in order to review and administer levies
  • To communicate with you, and with the accounting firms we work with, about our services and to respond to enquiries
  • To maintain accurate records and manage our client and partner relationships
  • To improve our software, services, and website
  • To send marketing communications and deliver relevant advertising, where you have not opted out
  • To track and analyse activity on our website so we can improve its performance and content
  • To comply with our legal and regulatory obligations
  • For any other purpose that we notify you of at the time your personal information is collected

How We Store and Protect Your Personal Information

We take all reasonable steps to ensure that the personal information we collect is:

  • Stored securely in a protected environment
  • Protected from unauthorised access, use, modification, or disclosure
  • Accurate, complete, and up-to-date

We use appropriate physical, electronic, and managerial security measures to safeguard personal information. Access is restricted to authorised personnel who require it to perform their duties. Personal information is currently stored in a secure, Datacom-hosted data centre located in Christchurch, New Zealand. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee the absolute security of information you send to us electronically.

We retain personal information for as long as required to fulfil the purposes for which it was collected, comply with legal and regulatory requirements, and manage our professional obligations. When personal information is no longer needed, we use secure methods to destroy or permanently de-identify it.

How We Disclose Your Personal Information

We do not sell, rent, or trade personal information. We may disclose personal information to:

  • ACC (the Accident Compensation Corporation), where necessary to review, query, or administer levies and refunds
  • The accounting firm that engaged us in relation to you, or that you are a client of
  • Third-party service providers who assist us in delivering our software and services (e.g., software, hosting, and IT providers), subject to confidentiality obligations
  • Advertising and analytics providers, such as Google and Meta (Facebook and Instagram), in connection with website analytics and marketing, as described in the Cookies and Website Tracking section below
  • Government agencies, law enforcement, or regulatory bodies when required by law or to protect our legal rights

Where you (or an accounting firm acting for you) engage us to review or administer ACC levies, we assume — unless you advise otherwise — that you have authorised us to liaise directly with ACC regarding your levies and any refunds. If a matter arises that we believe falls outside routine review or administration, we will seek your specific authority before acting.

Overseas Disclosure of Personal Information

Personal information is generally held by us in New Zealand. Some of our service providers — for example, cloud-based software, data storage, email, and analytics or advertising platforms — may store or process information on servers located outside New Zealand. Where personal information is disclosed to or held by a provider overseas, we take reasonable steps to ensure it remains subject to appropriate protections consistent with the Privacy Act 2020.

Cookies and Website Tracking

Our website uses cookies and similar technologies to improve your browsing experience and help us understand how visitors use our site. Cookies are small text files stored on your device that allow us to recognise your browser and record information such as the pages you visit, the actions you take, the links you click, and the time you spend on our site.

We use this information to operate and improve our website, to analyse site performance and usage, and to make our advertising more relevant. Some cookies are essential for the website to function, while others are used for analytics and marketing purposes and are only used where permitted.

Analytics

We use analytics tools such as Google Analytics to understand how our website is used and to improve its performance and content. These tools collect information such as cookies, IP addresses, device and browser identifiers, referring and exit pages, and on-site behaviour. This information helps us understand overall usage patterns rather than identify you personally.

Facebook Pixel and Social Media Tracking

Our website uses the Facebook Pixel (also known as the Meta Pixel), a piece of tracking code provided by Meta Platforms, Inc. The Facebook Pixel allows us to measure the effectiveness of our advertising, understand the actions visitors take on our website, and deliver more relevant advertising to you on Facebook, Instagram, and other platforms within the Meta network.

When you visit our website, the Facebook Pixel may collect information such as your device and browser details, IP address, the pages you view, and the actions you take on our site. This information may be matched by Meta with your Facebook or Instagram account (where you have one) and used to build audiences for remarketing and targeted advertising, and to report on the performance of our campaigns. Meta processes this information in accordance with its own data policy.

We may use similar tracking tools and pixels provided by other advertising and social media platforms, such as Google and LinkedIn, for the same purposes.

Managing Cookies and Opting Out

You do not have to accept cookies. Most browsers allow you to refuse or delete cookies through your browser settings, though turning cookies off may limit some features of our website and affect your experience. You can also manage how you receive personalised advertising through the privacy or ad settings provided by the relevant platforms — for example, through your Facebook and Instagram ad preferences, and through Google's ad settings — and through your device or browser controls.

Marketing Communications and Remarketing

We may collect personal information from you when you visit our website, submit a form, contact us, follow or interact with us on social media, or subscribe to our updates. This information can include your name, contact details, basic demographic information, and details about how you use our website (such as pages viewed and links clicked).

We use this information to improve our website, respond to enquiries, provide our services, and send you marketing communications (such as newsletters, event invitations, service updates and special offers) that we believe may be relevant to you. We may also use website and social media activity data to create audience lists for remarketing and targeted advertising on platforms such as Google and the Google Partner Network, Facebook, Instagram and LinkedIn.

You can opt out of email marketing at any time by using the unsubscribe link in our emails or by contacting us. You can manage how you receive targeted advertising by adjusting the privacy or ad settings within the relevant platform or your browser.

Your Rights Under the Privacy Act 2020

Under the Privacy Act 2020, you have the right to:

  • Access the personal information we hold about you
  • Request correction of any inaccurate, incomplete, or out-of-date information
  • Request deletion of your personal information in certain circumstances, for example where we no longer need it or where you withdraw a consent we have relied on
  • Withdraw your consent at any time where we rely on your consent to process your personal information
  • Ask us to stop, or restrict, the processing of your personal information in certain circumstances, including where you object to direct marketing
  • Ask questions about how we handle your personal information
  • Make a complaint to us or to the Office of the Privacy Commissioner if you believe we have breached your privacy

To exercise any of these rights, please contact us using the details below. We will respond to your request within a reasonable timeframe and in accordance with the Privacy Act 2020. Please note that some of these rights may be limited where we have a legal obligation or an overriding legitimate reason to continue to hold or process the information. Where information has been provided to us by an accounting firm in relation to their client, we may direct certain requests to that firm.

Privacy Breach Notification

If we experience a privacy breach that has caused, or is likely to cause, serious harm to you, we will notify the Office of the Privacy Commissioner and any affected individuals (including you) as soon as reasonably practicable after becoming aware of the breach, in line with our obligations under the Privacy Act 2020.

Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. Any updates will be posted on our website with a revised effective date. We encourage you to review this policy periodically.
